Ok. That makes sense. I will contact the HQ and try to find out the solution. Calling the local SS office doesn't help as the first thing their automated system asks for is SS# for you to move on!

Not to discourage any one but , my understanding from this forum is nothing with respect to RETROGRESSION and THUS OF SKILLED PEOPLE LEAVING THE SHORES will be done in the Lame duck session.
I wish some one prove me wrong and let us know if there is any new news.
Hello ,
It is unrealistic to expect something to happen with out participation. My sincere REQUEST to "YOU" all is
i) BECOME A MEMBER : If you are guest and visiting this site to know about retrogression and your self waiting for a green card and stuck due to retrogression, become a member and participate the forum.
ii)TELL YOUR FRIENDS : If you are member and have not told about this forum to your other retrogression stuck friends/collegues, please do so.
iii) CONTRIBUTE : if you are a member, and have not contributed, please think of contributing
iv) PARTICIPATE : participate this forum more actively with your comments.
It has been the appeal of IV core team MANY times for i), ii) & iii) above.
Also I have seen on many web sites related to green cards, it is suggested to come forward and let know your problems .. Things otherwise, may not happen magically.
Friends on the forum, who think likewise and IV team, please add/correct my comments.

I am not from NOLA, but i recommend naming the title of any thread more than just one word. The simple reason being, it gets lots in the list of other threads on the R.H.S. Just a suggestion

What are all the documents needed for travel on AP? I am travelling JFK->Dubai->India. I am guessing there is no transit visa mess involved here since there is no Europe stop.
Documents are
1) 3 sets of AP valid till october 2008
2) EVL
3) Current pay stubs
4)H1 approval (valid till 2010, no needed but still have it)
Do I need w2 and tax returns etc?
Thanks

Go to the web site http://www.cic.gc.ca/english/index.asp and review your different options.
You can immigrate base dupon family sponsorship, employment or just the point system without employment.
I qualified by point system without employment offer. You can take the test on line for free to see if you qualify by the point system.
Best of Luck
Just go on their website down load form and send it to them. Do not need any attorney. Point sytem should be the best option for you. Filling up the forms are pretty simple.

Like I said earlier, you have 240 days before you go out of status. If you are receiving an RFE, it means your case is under review. Upon receiving your response to the RFE, the officer should be able to adjudicate case fairly soon. However, if you are nervous, I recommend file for an expedited review when sending your response. That said, I would hate to pay the extra $$$$ if I don't have to.

I am in need of this info and want to clarify my doubt. Please reply soon.
Both parents were in India and Indian Citizens by birth at the time of birth of their chidren in India. Birth of year for children is 1996 and 2000 (still minor). As such both children are Indian Citizens by birth.
If one or both the parents acquire foriegn (Canadian) citizenship and does not apply for Canadian citizenship for their children, does it affect Indian Citizenship of their minor children in that case? Will the children automatically loose their Indian Citizenship? or children can still be Indian citizens as they have not acquired foriegn citizenship, even if parents have acquired/renounced the Indian citizenship? (Parents have to write to Indian Consulate that they are renouncing their own Indian Citizenship due to acqusition of foriegn citizenship in order to get Indian Visa for themselves.)
This doubt originated due to information in Wikipedia under Citizenship Act of 1955, which has a clause which says "Renunciation is covered in Section 8 of the Citizenship Act 1955. If an adult makes a declaration of renunciation of Indian citizenship, he loses Indian citizenship. In addition any minor child of that person also loses Indian citizenship from the date of renunciation. When the child reaches the age of eighteen, he has the right to resume Indian citizenship. The provisions for making a declaration of renunciation under Indian citizenship law require that the person making the declaration be "of full age and capacity."
Regards,

A friend of mine has PhD in aeronautics from a top tier university here in US. He will be soon starting teaching in a university and planning to file his GC under EB-1.
Are there any risks in getting I-140 approved under EB-1? or just having a PhD does not automatically qualify anyone under EB-1 category.?
Since he is born in India so reluctant to file under EB-2 due to endless wait.
Depends on whether the role for which he is applying requires a PhD or not. Once again, consult a good lawyer.

How can they ask W2 for all years. Nobody keep W2 for more than 3 years. That what they recomments usually. They used to askf or only 3 years of W2. I never heard anything like this. If they start asking for all W2s, then 90% won't get green cards. They are making life miserable for grene card aspirants

HI
My wife is US citizen and I am applying GC through her. We need to goto India for her sister's wedding on Aug 9th. How long does it take for AP to be approved? Can we expedite AP for wedding reason or should we do only for medical reason ? We live in California.

Answers:
1. Yes.
2. Yes.
3. No issues. You have approved I140, and using this you can get 3 year extension. But be careful to be discreet about the job change, because by any chance if your current employer revokes the I140, before your extension approval, you will be in trouble. (Because the basis for approval of beyond 7nth year extension is your approved I-140.)
1. Can I change my employer?
2. Can I retain my Priority date?
3. If the new employer files for transfer of H1, what does it mean to my extension beyond 7th year?

Hello,
My 140 is approved. My H1b is already extended for 3 years.
1) Can my spouses H1b get 7th year extension based on this?
2) If not, can my spouse move to H4?
Thank you.

This rose bloom stood out so well against the foliage background, that I thought I'd try a little different composition in which the main subject is a small part of the frame. Does this composition work or does it need to be cropped?
