    :confused: But the dates having moved beyond the April 2000 deadline ( may be temporarily), why should they not move fast when the VB was current for a long time and there should not be many cases after April 2000 those were not adjudicated. So I feel if the dates don't retrogress then they should move forward faster.

    Hi,

    I am going to get married next week.

    I am a H-1b visa holder and I have applied for green card. I am waiting to get approval of I-140.

    I want to file the H-4 visa for my wife and I have couple questions :

    1) How difficult is to apply for H-4 ? Do I need a lawyer for that ?

    2) How will my new status effect my green card application ? Do I need to apply again for I-140 ?

    I am working in US on L1A visa expiring in November 2010 (completing 7 years). The Visa with whom I am working are not processing my GC. Before changing my Visa to L1A, I had H1B which is expired now. So I am applying for PERM through another employer. This employer/attorney is going to file for Labor in one or two months. What are the chances of my Labor and I-140 getting approved before December 2010? If my Labor got approved by December 2010, Can I switch to the employer who has applied for PERM and continue staying in US? Are there any options? Please advice. Thanks for your time.

    PERM processing for non-audited cases is taking anywhere from 8-12 months these days. Assuming your case does not come under audit, then yes, with premium processing of I-140, you can expect both your Labor/I-140 being approved by Dec 2010 (assuming the 8-12 month PERM processing times still hold good)

    Hi All ,

    I am currently on L1B visa valid till Mar 09.

    I can apply for renewal for the same in Sep 09 and wanted to check if there would be any issues as if i travel to india and return on the old petition in oct-nov 08 (in case the renewal is still pending).

    Will my return on the old petition cancel my L1 renewal petetion ?

    I am trying to get the L1 renewed as soon as possible so that i can file for EAD renewal for my spouse.

    Any views would be greatly appreciated.

    Not advisable to apply for L1 extension now. You should do it after you are back from India. That is because, they will also extend your I-94 when you apply for extension (i.e the L1 extension approval notice will list your current I-94 number).

    You would'nt want to end up in a state where you leave the country and return your current I-94 at the airport and CIS approves an extension on that I-94 (which you no longer have).

    When you return, you will have a different I-94 that will be valid till Mar 09 and you have to file for extension again with that I-94. Alternately, you may go out of the country to get a new visa stamp before Mar 09 and re-enter with that visa stamp and get a new I-94...

    convoluted, isnt it? Better to make that trip, come back, get a new I-94 and use that to extend your status.

    BTW, whats your port of entry.

    While leaving take all appropriate documents like Paystubs, Employment Verification Letter etc and also you vacation approvel details if needed.

    Hello Gurus,

    Here is my situation and I really appreciate your advice:

    I have filed my I-485, EAD, and AP thru my employer (consulting company) in EB3 category. I have received my EAD and AP but i havent invoked AC21.

    I also have approved labor (PD--01/2006), and approved I-140 in EB2 category thru my client's company.

    Since, EB3 category is not going anywhere, I am thinking of filing another I-485 thru my client in EB2 category.

    1) Is it possible for me to file second I-485 in EB2 category while first I-485 is waiting for approval?

    2) Can i port my EB3 PD (12/2003) while filing 2nd I-485 thru client?

    No need to file 2nd I-485.

    Just update your existing I-485 with 2nd I-140 and claim earlier PD. You can claim PD with EB2.

    Your lawyer should be able to do that.

    That is correct. If you are married and over 21, they can't apply unless they are U.S. Citizens. But then, you will be under FB 3rd category which means a very long wait.

    My case is similar too, my husband filed 485 for both of us on 29th June, we both have H1b. But on June 15th one H1b transfer was filed for me (dependent in 485) which was confirmed to us on June 22nd and I joined new company on June 26th.
    But the whole transfer thing is not mentioned in 485 because we were not aware at time of filling forms (june 18th).

    Is this going to create problem? do we need to send update/form to USCIS about this?

    EAD 1: valid from Jan10 2005- Jan 9, 2006

    on July 11, 2005 you applied for EAD 2

    On July 29 , 2005 you got it approved. What will be EAD 2 's start date? 30 July , 2005 or Jan10, 2006?
    Approval date - Jul 29 2005 will be start date for EAD.

    QUESTION::
    Can we use automatic revalidation to enter USA without getting our visa's stamped. My h1 expired in 2006 and my spouse�s H4 expired in 2006.
    (Remember my spouse is applying for H1 )
    ANSWER:: No, with Canadian GC you can not enter USA for long term work, without stamping. I think entry for one month is permitted.

    QUESTION:: How safe it is Frequent travel to Canada and back
    ANSWER:: It is safe to cross US and Canada border, if you have multiple entry visa.

    QUESTION:: How safe it is to stay in Canada for duration of 3-6 months and come back to USA
    ANSWER:: As long as you are in H1 B there is no restriction. In future if you enter I-485, there are complications, if you continue to travel back and forth at that time too.


    QUESTION:: Once my spouse gets the H1 approved, should he move to H1 immediately or can continue on H4?
    ANSWER:: Once the H1 is approved and if the new I-94 is attached at the bottom of the H1 approval, then it means the status from H4 to H1 is transferred. If there is no I-94 then the status will get transferred while you get the visa stamping.

    ANSWER:: It is ok to apply for stamping in Canada, because you have a residency there. If there is an issue then US embassy in Canada may ask you to get it stamped in your home country.

    In the 485 filings for me and my wife, my divorce certificate for my previous marriage was put in my files but it should have been with my wife's file per 485 intruction because she is the derivative applicant. If USCIS can't find it in my wife's file, will USCIS look for it in my file since we filed together?

    If this is not required as initial evidence then they will issue an RFE and then you can send the documents later.

    To fix the problem, could we resubmit my wife's 485 now and withdraw the one just submitted even though we don't have the receipt for it yet? or should we wait until we get receipt for the one just submitted and then resubmit her 485 application when my PD become current again? or could we just submit the missing file after we get the receipt and my PD becomes current?

    Don't resubmit your wife's application, wait for a receipt

    I will be laid off from an american company by the end of Feb 2009. I spoke to my previous desi employee as my H1b with his company is still valid and he din't revoked it until now

    But he agrees to let me join his company but at the same time he worried about few things



    Q1) I was with him for 6 months of 2008 and moved to an American Company so the total pay in the W2 for year 2008 is less than LCA amount.
    Would that be a problem as i din't work with him for an entire year in which case it is bound to be less than LCA amount..
    Mind you i'm looking at the Yearly wage if you look at month wise it is much higher than mentioned in LCA.

    Would that be of any problem to both me and employeer.

    Q2) He also said that when somebody re hires any one , the employeer is liable to pay back wages for the period of time he was out.

    It sounds illogical atleast to me because he didn't terminate me from the job it was me who quit the job and transferred my H1b on a good note , but there is no official document saying i quit the job or he terminated me ....


    I would appreciate if some could throw some light on this ....

    My future is relied on these issues

    What about using AP for status check? Will they accept that?
