My 6th year finishes October 2010. My LC is pending for more than one year. If I transfer my H1B from Company A to Company B, Can I get 7th year extension with Company B based on pending Labor with Company A?

Yes, company B can file for extension of your H1 for 1 yr by attaching proof of labor filing showing it has been filed and its pending for more than an year.

Hi,
I am currently in L1B visa , i am in US for 40 Months. The total period that i can be in US in L1B is 5 yrs .

I am planning to do my H1B this year (2008), having already elapsed 40 months, if i get a H1B will the period elapsed ( 40 months in L1B) be accounted or i will get the H1b for 3 yrs.

I do not have personal experience with Fragomen; however I have heard that it is the large immigration law firm in the country.

The only problem (as far as I know) with them is that your PERM WILL be audited (according to DOL memo). This may lead to delays (and god only knows how long...)

Most people on this forum know this fact; I mentioned it as you appear to be the novice player...

Fastest way to move to H4 is goto India and get your H4 stamped or file I539 for COS to H4. If you apply for COS to H4, you application will be in pending state considering all the backlogs as VSC/CSC. You can move to H1 whenever you wish and you will not be counted against quota, provided you have not exceeded the 6 year limit.

Hi currently I am on H1B which is set to expire at end of November and will not be renewed. I have another position coming up but the visa application may not b e done till late December or January. I would need to transfer to H4 on my spouses status till then.

Can some one guide me in this process. What steps must be taken to transfer from H1B to H4? Is there any webpage which explains this step?

Is is better to file for H4 from USA itself or to go to India and do it?

Once I file for H4, does it have any impact on my filing for H1 from the new employer later in December or January?

Is it possible to ship the two I-485 pakcages to INS?

My labor and 140 already approved. My law firm preparing I-485 to submit through same day service.

In case if they are not able to do it within the time, I want to submit I-485 on Monday through same day service without telling to the law firm.

This causes duplicate submission. Can I or law firm subsequently with draw one of the I-485 later?

Please advise. Urgent. Appreciate your help.

There is nothing you can do now. You cannot change the past. Realistically there is only a very small probability that it will become an issue at 485 approval stage.

Even otherwise, this was Employer's responsibility, not yours, to keep your LCA updated.

Hi Gurus,

My wife has her H4 Visa stamp until 1st Oct 2010. She is in India. I am planning to visit India and travel back with her. If my visa gets stuck in "Admin Processing" will my wife be able to travel back on her valid H4 Visa.

She has to travel back due to some personal reasons.

Please advise.

yes, She will be able to return back as long as you both dont go for stamping together. If you get stuck in Admin Processing then they will cancel her current visa until you get your visa since she is dependent on you.

So the best thing to do is, you go for stamping first and if it works out for you then let her go for stamping afterwards or She can enter using her current visa and then file an extension before it expires.

The important thig is the period since yoour last admission to the US before July 2007.

Say you entered in Apr 2007 then you would not have accumulated 180 days of unauthourized stay in US before filling 485 and you will be OK.

Has anyone in Charlotte, NC got a extension on the Driver's license on the basis on the H1-B renewal application receipt.

My spouse's driver's license expires this month end. I have applied for h1-b/h4 renewal, yet to receive the application receipt.But wanted to know if anyone here in Charlotte,NC got a extension/grace (30days or 90days) on the basis of the receipt.

I have received my green card 5 months ago and still working for the same GC filing employer(a consulting company). My wife had an RFE on her GC, since she could not take MMR at 2007 fiasco time. We have recently replied with the evidence. Now my project is getting over at the client site in next couple of weeks. I am sure that I can lose my job at consulting company also.
My question is, what happens to wife's GC? What if there is another RFE and how can I reply it?
Please let me know my options.
